Terms of Service

These Terms of Service ("Terms", "Agreement") constitute a legally binding contract between you ("User", "Sender", or "Carrier") and Passpost AS ("Passpost", "we", "us", or "our"), a company operating a peer-to-peer delivery marketplace platform. By accessing or using the Passpost platform, mobile application, or any related services (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
Important notice
Please read these Terms carefully before using the Passpost Platform. These Terms contain important provisions including a binding arbitration clause, limitations of liability, and disclaimers of warranties. If you do not agree to these Terms, you may not use the Platform.
1. Definitions
- Platform — the Passpost website, mobile applications, APIs, and all associated software and services.
- Carrier — any verified individual who offers to transport items on behalf of Senders through the Platform.
- Sender — any User who posts a delivery task and engages a Carrier through the Platform.
- Task — a specific delivery request created by a Sender on the Platform.
- Escrow — the mechanism by which payment is held by Passpost pending confirmed delivery.
- Handover Code — the unique alphanumeric code used to confirm pickup and delivery of items.
- Verified Carrier — a Carrier who has completed Passpost's identity, phone, and route verification process.
- NOK — Norwegian Krone, the primary transactional currency of the Platform.
2. Eligibility
To use the Platform, you must:
- Be at least 12 years of age;
- Have the legal capacity to enter into binding contracts;
- Not be prohibited from receiving services under applicable law;
- Possess a valid government-issued ID and an active phone number capable of receiving SMS verification; and
- Agree to these Terms in their entirety.
By registering an account, you represent and warrant that you meet all eligibility requirements. Passpost reserves the right to suspend or terminate accounts of Users who do not meet these requirements.
3. Account Registration & Security
3.1 Registration
You must register an account to access core Platform features. You agree to provide accurate, complete, and current information during registration and to update such information to keep it accurate.
3.2 Account Security
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify Passpost immediately at legal@passpost.io if you suspect any unauthorized access or use of your account.
3.3 One Account Per User
Each User may maintain only one active account. Creating duplicate or fraudulent accounts is prohibited and may result in permanent suspension of all associated accounts.
4. Description of Services
4.1 Marketplace Platform
Passpost operates a peer-to-peer delivery marketplace that connects Senders who need items transported with Carriers already travelling along compatible routes. Passpost facilitates same-day and next-day deliveries on live human routes across city-to-city, cross-border, and diaspora corridors on every continent.
4.2 Carrier Tiers
The Platform currently supports peer-to-peer Carriers operating on their own schedules. Future tiers may include AI-optimized bundles and full-time Carrier arrangements, subject to updated terms communicated in advance.
4.3 Use Cases
Documents and contracts, city-to-city and region-to-region deliveries, student luggage, cross-border items, keys and access cards, hotel and airport runs, marketplace pickups (including eBay and Vinted), spare parts, business courier services, same-day urban deliveries, recycling runs, old electronics, and diaspora deliveries between home countries.
4.4 Platform as Intermediary
Passpost acts solely as an intermediary marketplace and is not a party to any delivery contract between Senders and Carriers. Passpost does not employ Carriers and is not responsible for the actions, omissions, or conduct of any Carrier or Sender.
5. Carrier Obligations & Verification
5.1 Identity Verification
All active Carriers must complete Passpost's verification process, which includes government-issued ID verification, phone number confirmation, and route validation before claiming any Task. Carriers who fail verification or provide false information will be permanently removed from the Platform.
5.2 Operational Obligations
- Accurately represent your route, timing, and capacity when claiming a Task;
- Collect and deliver items in the condition received, as documented by the photo trail;
- Use the in-app chat exclusively for communications with Senders (personal phone numbers must not be exchanged);
- Confirm pickups and drop-offs using the unique Handover Code provided;
- Capture photos at both pickup and delivery as proof of condition;
- Comply with all applicable customs, border control, and import/export regulations;
- Refuse to carry Prohibited Items as defined in Section 7.
5.3 Independent Contractor Status
Carriers are independent contractors and not employees, agents, or partners of Passpost. Carriers are solely responsible for their own taxes, insurance, and compliance with applicable employment and transportation law.
5.4 Ratings
Carriers are subject to public ratings and reviews. Passpost reserves the right to suspend or remove Carriers who fall below minimum quality thresholds or receive substantiated complaints.
6. Sender Obligations
- Accurately describe all items to be transported, including dimensions, weight, and fragility;
- Ensure all items are lawfully owned by you or that you have authority to send them;
- Package items appropriately to withstand transportation without damage;
- Be available at the agreed pickup time and location;
- Confirm receipt of items using the Handover Code;
- Not instruct Carriers to carry Prohibited Items;
- Provide accurate pickup and delivery addresses and recipient contact details.
Senders who misrepresent items or provide false information may be liable for resulting costs, delays, legal consequences, and will be subject to account suspension.
7. Prohibited Items & Activities
7.1 Prohibited Items
The following items are strictly prohibited from being transported via the Platform:
- Illegal drugs, narcotics, or controlled substances;
- Firearms, ammunition, explosives, or weapons of any kind;
- Counterfeit goods, pirated materials, or goods infringing intellectual property rights;
- Endangered species, live animals, or animal products prohibited under CITES;
- Hazardous materials including flammable, corrosive, or toxic substances;
- Cash, bearer instruments, or monetary equivalents exceeding applicable legal thresholds;
- Human remains or biological samples;
- Items subject to trade sanctions, embargoes, or export controls;
- Any item whose transportation is prohibited under applicable local, national, or international law.
7.2 Prohibited Activities
- Use the Platform for any unlawful purpose or in violation of these Terms;
- Circumvent Passpost's payment systems or conduct off-platform transactions;
- Create fake Tasks, listings, or reviews;
- Harass, threaten, or discriminate against other Users;
- Attempt to reverse-engineer, hack, or interfere with the Platform.
8. Fees, Payments & Escrow
8.1 Service Fees
Passpost charges a service fee on each completed Task. Current fee schedules are displayed on the Platform at the time of Task creation and may be updated from time to time. Fees are denominated in NOK unless otherwise specified.
8.2 Escrow Mechanism
Upon a Sender accepting a Carrier's offer, payment (including the Carrier's reward) is held in escrow by Passpost. Funds are released to the Carrier only upon confirmed delivery, which requires recipient confirmation via the Handover Code. Passpost reserves the right to withhold payment pending resolution of any active dispute.
8.3 Taxes
Each User is solely responsible for determining and remitting any taxes applicable to payments received or made through the Platform. Passpost does not withhold taxes on behalf of Users unless required by law.
8.4 Currency & Processing
Passpost uses third-party payment processors. By using the Platform, you consent to the terms of such processors. Passpost is not liable for errors or delays caused by third-party payment systems.
9. Cancellations & Refunds
9.1 Sender Cancellations
Senders may cancel a Task without charge prior to a Carrier claiming it. Cancellations made after a Carrier claims the Task may be subject to a cancellation fee.
9.2 Carrier Cancellations
Carriers who cancel accepted Tasks may incur penalties including lower ratings, reduced Task visibility, and potential account suspension for repeated cancellations.
9.3 Failed or Disputed Deliveries
In the event of a failed delivery, items lost in transit, or damage, Senders may file a dispute through the Platform within 48 hours of the scheduled delivery time. Passpost's moderation team will review the dispute, considering the photo trail, chat logs, and Handover Code records, and issue a determination. Passpost's decision is final subject to applicable law.
9.4 Refund Eligibility
Refunds are issued solely at Passpost's discretion following a dispute determination. Passpost's maximum liability to any Sender for a lost or damaged item is limited as set out in Section 10.
10. Liability & Disclaimers
10.1 Disclaimer of Warranties
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Passpost does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
10.2 Limitation of Liability
To the maximum extent permitted by applicable law, Passpost's total liability to you for any claims arising out of or related to these Terms or the Platform shall not exceed the greater of: (a) the total fees paid by you to Passpost in the 12 months preceding the claim, or (b) NOK 500.
10.3 Exclusion of Consequential Damages
In no event shall Passpost be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or damage to reputation, even if Passpost has been advised of the possibility of such damages.
10.4 Carrier Liability
Carriers are solely liable for items in their possession during a Task. Passpost's escrow mechanism does not constitute insurance. Carriers are strongly encouraged to obtain appropriate courier or transport insurance.
10.5 Environmental Claims
Passpost's environmental claims (including reduced CO₂ by utilising existing travel routes) are indicative and based on general assumptions. Passpost makes no guarantee of specific environmental outcomes.
11. Intellectual Property
All intellectual property rights in and to the Platform, including software, trademarks, trade names, logos, designs, text, graphics, and underlying technology, are owned by or licensed to Passpost. Nothing in these Terms grants you any right, title, or interest in Passpost's intellectual property except the limited licence to use the Platform in accordance with these Terms.
By submitting content (including reviews, photos, or messages) to the Platform, you grant Passpost a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, and distribute such content for Platform operation and promotional purposes.
12. Privacy & Data Protection
Passpost's collection and use of personal data is governed by our Privacy Policy, incorporated into these Terms by reference. By using the Platform, you consent to the processing of your personal data as described in the Privacy Policy.
Passpost implements appropriate technical and organisational measures to protect personal data in accordance with applicable data protection legislation, including the GDPR where applicable. In-app communications between Senders and Carriers are not monitored, tracked, or logged by Passpost. Phone numbers are never shared between Users, keeping personal contact details fully private at all times.
Passpost operates internationally. By using the Platform, you acknowledge that your data may be transferred to and processed in countries other than your country of residence.
13. Dispute Resolution & Arbitration
13.1 Informal Resolution
Before initiating formal proceedings, you agree to attempt to resolve any dispute with Passpost informally by contacting legal@passpost.io. Passpost will endeavour to respond within 10 business days.
13.2 Binding Arbitration
If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be finally resolved by binding arbitration administered by the Norwegian Arbitration Act (voldgiftsloven) before a sole arbitrator in Oslo, Norway, unless applicable consumer protection laws in your jurisdiction provide for different dispute resolution mechanisms.
13.3 Class Action Waiver
To the extent permitted by law, you waive any right to participate in a class action lawsuit or class-wide arbitration against Passpost.
13.4 Consumer Rights
Nothing in this Section limits any statutory rights you may have as a consumer under applicable Norwegian or EU consumer protection legislation.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to conflict of law principles. Subject to Section 13, any legal proceedings not subject to arbitration shall be brought exclusively in the courts of Stavanger, Norway.
15. Amendments
Passpost reserves the right to modify these Terms at any time. Material changes will be communicated via in-app notification or email at least 14 days before taking effect. Continued use of the Platform following the effective date of any amendment constitutes acceptance of the updated Terms. If you do not agree to amended Terms, you must discontinue use of the Platform.
16. Miscellaneous
- Severability: If any provision is found invalid, the remaining provisions continue in full force.
- Waiver: Failure to enforce any right does not constitute a waiver.
- Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement.
- Assignment: You may not assign your rights without prior written consent. Passpost may assign without restriction.
- Force Majeure: Passpost is not liable for delays caused by events beyond its reasonable control.
- Language: These Terms are drafted in English; the English version prevails in case of conflict.
